Federal Judge Roger Vinson of Florida has ruled that the entire health care reform law (ObamaCare) must be invalidated because the individual mandate is unconstitutional.
Vinson said, “because the individual mandate is unconstitutional and not severable, the entire Act must be declared void.”
Laws usually contain language that makes provisions “severable” — that is, if part of the law is stricken down as unconstitutional, the rest of the law can stand. But Congress failed to include such language in the bill. So if part is stricken down, all of it must be invalidated.
