The 11th Circuit Court of Appeals has just ruled that the individual mandate element of ObamaCare is unconstitutional, exceeding the powers granted to Congress under the Constitution.
Update: More from the decision:
we conclude that the individual mandate contained in the Act exceeds Congress’s enumerated commerce power.”
Boom.
The court ruled that the rest of the law can stand without the mandate, but even pro-ObamaCare Democrats admit the scheme falls apart without the unconstitutional bit.
Interesting: One of the judges who ruled the mandate unconstitutional was Judge Frank Hull — a Clinton appointee.
